Submission Licence & Contributor Terms

1. Scope

These Contributor Terms apply when you submit a photograph, caption, description, correction, location information or other material to FacesOf (a Submission). You accept these terms when you create your account, or when FacesOf asks you to accept a newer version. That acceptance applies to Submissions you make while that version is in force; you do not need to accept the same terms again for every individual photo or contribution.

You must be legally capable of granting the rights described here. If the law that applies to you requires permission from a parent, guardian or other person, you must have that permission before making a Submission.

2. You keep your rights

You keep the copyright and other rights you hold in your Submission. FacesOf does not acquire ownership of your photograph merely because you submit it.

3. Licence to FacesOf

You grant FacesOf a non-exclusive, worldwide, royalty-free licence, for the duration of the rights you grant and subject to section 10, to use your Submission for operating, developing, documenting, preserving, curating and promoting the FacesOf project.

To the extent permitted by applicable law, this includes the right to:

• host, store, reproduce and back up the Submission;
• display, publish and communicate it through FacesOf websites, apps, maps, collections and other project interfaces;
• resize, crop, compress, colour-correct, convert formats and make reasonable technical or editorial adjustments that do not materially misrepresent the work;
• use it in FacesOf editorial material, social media, press material, presentations, educational material and project promotion;
• reproduce and display it in curated FacesOf exhibitions, installations, talks, publications and archival or cultural presentations, including physical exhibition copies that are not sold as standalone commercial art prints; and
• allow hosting providers, printers, cultural institutions, contractors and other project partners to exercise only the rights reasonably necessary to provide those FacesOf-related services.

The licence is non-exclusive. You remain free to publish, license, sell or otherwise use your own work elsewhere.

4. Standalone commercial prints and merchandise

This contributor licence does not by itself allow FacesOf to sell your photograph as a standalone art print, postcard, merchandise item, stock image or similar product whose principal value is your photograph.

If FacesOf wants to make that kind of commercial use, it will seek a separate agreement with you first. That agreement can specify the product, duration, territory, attribution and any payment or revenue share.

This does not prevent FacesOf from funding the project through grants, sponsorship, exhibition admission, memberships or sales of broader editorial or cultural publications in which a Submission is included as part of the project rather than sold as the standalone product.

5. Attribution and moral rights

Where reasonably practicable, FacesOf will credit the public username or contributor name associated with the Submission.

Nothing in these terms transfers or waives a moral right, right of attribution, right of integrity or similar author right that cannot validly be transferred or waived under the law that applies. Where such rights can be consented to or waived, you consent only to the reasonable technical and editorial changes expressly described in section 3.

6. Your promises

When you make a Submission, you confirm that:

• you created it yourself or otherwise have the rights and authority required to submit it and grant this licence;
• to the best of your knowledge, the Submission does not infringe another person's copyright, privacy, publicity, personality or other rights;
• where applicable law requires permission relating to an identifiable person prominently depicted in the Submission, you have obtained it;
• you did not need to trespass, damage property, defeat safety measures or break applicable law to make the Submission; and
• authorship and provenance information you provide is accurate to the best of your knowledge.

7. Location data and metadata

FacesOf may process location data and image metadata where reasonably necessary to verify discoveries, prevent abuse, maintain provenance and operate location-based project features.

FacesOf aims to collect and retain only the data needed for those purposes. Precise device location or embedded metadata should not be made public merely because it exists in an uploaded file. Public locations may be generalised where appropriate for privacy, safety, conservation or property-related reasons.

8. Automated checks and AI

FacesOf may use automated systems, including image matching, computer vision or machine-learning tools, to verify a Submission, detect duplicates, moderate content, create project metadata or improve FacesOf discovery features.

FacesOf will not knowingly use your Submission to train a general-purpose generative AI model, or license it to a third party for that purpose, without separate permission.

9. Curation and moderation

Submission does not guarantee publication. FacesOf may reject, hide, remove, or change contextual metadata around a Submission for curatorial, quality, legal, privacy, safety, technical or project-integrity reasons.

10. Removing a Submission

You may ask FacesOf to stop displaying a Submission. Subject to applicable law and legitimate retention needs, FacesOf will stop new public uses and remove the Submission from active online display within a reasonable period.

A removal request cannot necessarily undo uses already completed, such as exhibition material already produced or publications already distributed. Limited copies may remain in backups, legal records, fraud or moderation records, and internal archives where reasonably necessary and lawful.

11. No automatic payment or employment relationship

Ordinary participation does not create an employment, agency, partnership or commissioned-work relationship. Unless FacesOf and you separately agree otherwise, no fee or royalty is owed for uses permitted by section 3.

12. Changes to these terms

FacesOf may update these terms as the project evolves. A materially broader licence will not silently apply to an earlier Submission. Where new permission is needed, FacesOf will ask for it.

13. Applicable law and mandatory rights

Copyright, privacy, consumer and personality rights vary between countries. These terms are intended to operate internationally and must be interpreted together with the law that applies in the relevant circumstances.

Nothing in these terms excludes, restricts or overrides rights or remedies that cannot lawfully be excluded, restricted or waived. A separate FacesOf Terms of Service may identify the project operator and a contractual governing law or forum for the service; such a clause does not override mandatory protections that apply under other relevant law.
